1. Our Commitment

Thank you for purchasing a Tensive Effects product. We are committed to providing you with high-quality products. This document outlines the terms and conditions of the voluntary manufacturer's warranty provided by Tensive Effects for products purchased in Australia.

2. Warranty Provider

This warranty is provided by:

  • Business Name: Tensive Effects
  • ABN: 74 924 175 117
  • Business Address: PO Box 4501, Baldivis WA 6171, Australia
  • Contact Email for Warranty Claims: support@tensiveeffects.com

3. Your Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits provided to you under this Tensive Effects warranty are in addition to other rights and remedies available to you under the Australian Consumer Law. This warranty does not limit or replace your rights under the Australian Consumer Law.

4. Warranty Period

This warranty is valid for twelve (12) months from the original date of purchase by the first owner. Proof of purchase is required to validate the warranty period.

5. Who is Covered?

This warranty is offered exclusively to the original purchaser of the Tensive Effects product and is non-transferable.

6. What This Warranty Covers

Tensive Effects warrants that your product will be free from defects in materials and workmanship under normal use and service for the Warranty Period.

7. What This Warranty Does NOT Cover (Exclusions)

This warranty does not cover:

  • Cosmetic damage, including but not limited to scratches, dents, and normal wear and tear.
  • Damage caused by accident, abuse, neglect, misuse (including but not limited to damage to knobs, switches, or the enclosure from excessive force, impact, or improper handling).
  • Damage caused by the use of an incorrect power supply (e.g., wrong voltage, incorrect polarity, AC power instead of DC power, or power supplies not meeting the product's specified requirements). Please refer to your product manual for correct power supply specifications.
  • Damage caused by liquid spillage, exposure to excessive humidity, extreme temperatures, or other adverse environmental conditions.
  • Damage caused by or issues arising from any modification, alteration, or attempted repair by any person not authorised by Tensive Effects.
  • Products where the serial number has been damaged, altered, or removed (if applicable).
  • Any subjective issues regarding tonal characteristics, unless a clear functional defect is present.

8. Damage During Initial Shipping (Dead on Arrival - DOA)

If your Tensive Effects product arrives damaged from the initial shipping process, please contact us at support@tensiveeffects.com within seven (7) days of receipt. You will need to provide your order details and photographic evidence of the damaged product and packaging. Damage sustained during initial shipping will be addressed as a shipping damage claim (which typically involves replacement of the damaged unit) and is handled separately from this warranty process.

9. How to Make a Warranty Claim

To make a claim under this warranty, please follow these steps:

Step 1: Contact Us:

Initiate your claim by contacting Tensive Effects via our support page at www.tensiveeffects.com/contact or by emailing support@tensiveeffects.com.

Step 2: Provide Information:

You will need to provide the following:

  • Your full name and contact details.
  • Proof of purchase (e.g., a copy of your dated sales receipt or invoice).
  • The serial number of the product (if applicable).
  • A detailed description of the suspected fault or issue.
  • Photographs or short videos illustrating the issue can be helpful and may be requested.

Step 3: Return Merchandise Authorisation (RMA):

If we determine that your product may require assessment, we will issue you with a Return Merchandise Authorisation (RMA) number and provide instructions on how and where to send your product. Products returned without a valid RMA number may be refused or experience significant processing delays. The RMA will be valid for a specified period (e.g., 30 days) within which you must send the product.

10. Assessment and Remedies

Upon receipt of your product with a valid RMA, Tensive Effects will assess the product to determine the nature of the fault and whether it is covered by this warranty. This assessment will be completed within a reasonable timeframe.

If a defect covered by this warranty is confirmed:

  • For a Minor Failure: Tensive Effects will, at its discretion, repair the product or replace it with an equivalent product (which may be new or refurbished).
  • For a Major Failure: You are entitled to choose between a refund, a replacement with an identical product (or one of similar value if an identical product is not available), or a repair.

Any repair or replacement under this warranty does not extend or renew the original Warranty Period.

11. Shipping Costs for Warranty Claims

You are initially responsible for the cost of shipping the product to Tensive Effects (or our designated service location) for warranty assessment. Please ensure the product is packaged securely to prevent damage during transit. If the product is assessed and found to have a major failure covered by this warranty, Tensive Effects will reimburse you for reasonable standard return shipping costs you incurred to send the product to us. Please retain receipts for your shipping expenses. If the product is assessed and found to have a minor failure covered by this warranty, Tensive Effects will repair or replace the product and cover the cost of shipping the repaired or replacement product back to you. If the product is assessed and found not to be faulty, or the fault is not covered by this warranty (e.g., due to an exclusion), you will be responsible for the cost of shipping the product back to you and may be charged an assessment fee. We will contact you before any non-warranty charges are incurred.

12. Turnaround Time

Tensive Effects aims to complete the assessment and/or repair of your product within approximately fourteen (14) business days from the date of its receipt at our designated service location. Please note that this is an estimate and actual turnaround times may vary depending on the complexity of the fault and parts availability. Shipping times to and from Tensive Effects are not included in this estimate and are beyond our direct control. We will endeavor to keep you informed of any significant delays.

13. Limitation of Liability

To the extent permitted by the Australian Consumer Law and any other applicable legislation, Tensive Effects' liability under this warranty is limited to the repair, replacement, or refund of the product as set out in these terms. Tensive Effects is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the product, including but not limited to loss of profits or business interruption, except for any liability which cannot be excluded by law.

14. Governing Law

This warranty is governed by and construed in accordance with the laws of the Commonwealth of Australia.

15. Modifications to Warranty Terms

Tensive Effects reserves the right to change the terms of its warranty for future product purchases. The terms applicable to your purchase are those in effect at the date of your original purchase.
